91 applications for trademark registration of "Dingzhen" were rejected according to law (intellectual property report)

Recently, the Trademark Office of the State Intellectual Property Office issued the notice on rejecting 13 "Ding Zhen" trademarks according to law, 78 trademarks such as "Ding Zhen" and 91 applications for registration of relevant trademarks of "Dingzhen".


Among them, the circular on rejecting 13 "Dingzhen" trademarks according to law has made a decision on the rejection of 13 "Dingzhen" trademark registration applications such as No. 51763155 according to the provisions of Article 4, paragraph 1 (7) of Article 10 of the trademark law; and the circular on rejecting 78 trademarks such as Dingzhen according to law is in accordance with the provisions of Article 10, paragraph 1 (7) of the trademark law, The decision on rejection of 78 trademark registration applications, such as "Ding Zhen" No. 52279255, was made. Among the above rejected trademark registration applications, there are not only many trademarks named "Dingzhen", but also several trademarks related to Dingzhen, such as "Ding Zhen world", "I love Ding Zhen", "dingzhenzhen", "Dingzhen laugh" and so on.


In response, Wang Lianfeng, Professor of intellectual property College of East China University of political and law, said that the State Intellectual Property Office responded in time and rejected the malicious application for registration of "Ding Zhen" trademark in a timely manner, reflecting the determination and strength of trademark authorization authorities to crack down on malicious trademark registration according to law. The first paragraph of Article 4 of the Trademark Law revised in 2019 added the provision that "application for registration of malicious trademark for purposes of use should be rejected", which moved the gate of regulating malicious registration of trademarks forward, consolidated the legal basis for combating malicious registration of trademarks, and played a regulatory role in illegal acts such as the rush to mark "Ding Zhen".
